EU AI Act: The Tier System That Determines Your Fate
The EU AI Act tiers your product by risk. The tier you fall into determines your obligations, your launch timeline, and whether you can ship in Europe at all. Most US AI PMs misclassify their own product on the first read.
Prohibited (Cannot Ship)
Social scoring, real-time biometric ID in public spaces (with narrow exceptions), emotion recognition in workplaces or schools, exploitation of vulnerabilities. Active since Feb 2025. Penalty: up to €35M or 7% of global revenue. If your product touches any of these, you do not launch in the EU. Period.
High-Risk (Heavy Obligations)
AI used in employment decisions, credit scoring, education access, critical infrastructure, law enforcement, biometric ID. General-Purpose AI (GPAI) and Systemic Risk
Foundation models above 10^25 FLOPs of training compute (effectively GPT-4 class and up). Specific transparency, copyright, and safety evaluation obligations. If you are a foundation model lab, this is your tier. If you are a wrapper, the obligations roll down to your provider, but you remain on the hook for usage compliance.
Market-by-Market Reality: China, India, Brazil
The three biggest non-EU markets each have their own AI regulatory model. None of them resemble the EU. None of them resemble each other.
China: Algorithm Filing + Data Residency
Generative AI services to the Chinese public must complete algorithm filing with the CAC, undergo a security assessment, and store user data in mainland China. Foundation model registration is gated on "core socialist values" alignment, which functionally means you ship a different model in China. Most Western AI products ship via a JV or skip the market entirely.
China: The JV Reality
Microsoft, Apple, and most enterprise AI vendors operate in China through joint ventures or licensed local entities. Data leaves the country only under approved cross-border transfer mechanisms. Plan 12–18 months and a local partner for any serious China presence.
India: DPDP + Localization Pressure
Digital Personal Data Protection Act now enforced. Sensitive data localization requirements for finance, health, government. India does not have an AI-specific law yet, but the DPDP plus the Information Technology Rules cover most AI use cases. Expect formal AI law within 18 months — design for it.
India: Multilingual Reality
22 official languages. Hindi-only is a launch failure. Tamil, Telugu, Bengali, Marathi, Gujarati each have 80M+ speakers. AI models trained primarily on English perform poorly on Indic languages — your evals must be redone per language. Budget for it.
Brazil: LGPD + ANPD AI Enforcement
Lei Geral de Proteção de Dados is GDPR-shaped, plus ANPD has explicit AI authority since 2024. Penalties up to 2% of revenue capped at R$50M per infraction. Portuguese-language model performance and biased outputs are now an active enforcement area, especially in credit and employment.
Brazil: Localization Beyond Portuguese
Brazilian Portuguese is meaningfully different from European Portuguese — slang, formality conventions, regional dialects. Models tuned on European Portuguese feel wrong to Brazilian users. Treat them as separate locales.
Localization Is Not Translation

Layer 6: Pricing and Currency
What it means: Token pricing in USD does not work for emerging markets. Localized pricing in BRL, INR, IDR, NGN typically requires a 60–80% discount versus US pricing for parity purchasing power. Token-billed AI products bleed unit economics if they ignore this.
PM Implication: Either offer market-priced tiers with caps, or accept that your TAM in those markets is the top 5% by income. Pretending the US price works globally is the most common failure mode.

The Launch Sequence That Does Not Get You Fined
A defensible international AI launch follows a sequence. Skip steps and you ship into a fine, a takedown order, or worse — a viral incident that makes the local press.
1. Tier the product per market 90 days out
Not at launch. 90 days before. Map your features into each market's risk tier. Identify the features that flip you into a higher tier and decide whether to ship them, gate them, or pull them. This is a PM job, not a legal job.
2. Build the localized eval suite first
Before any launch announcement, you need quality numbers in the target language. Hire native speakers as evaluators. Build at least 200 graded test cases per language. "It feels fine" is not a quality gate.
3. Engage local counsel before product changes
Local counsel will tell you which features need to change, which disclosures are required, and what the enforcement risk actually looks like. Usually 6–8 weeks of work. Do it before the engineering team starts on localization, not after.
4. Run a dark launch with local users
30–60 days of unannounced availability with a small cohort of local users. Watch the metrics: filter false-positive rates, hallucination rates, complaint rates. This is where you find the bugs that would have made the press.
5. Disclose, document, deploy
Publish the model card, the data sheet, the local-language disclosure UX, and the support contact in-market. Documentation is the enforcement defense. "We did the work and here is the record" is what regulators actually want.
6. Plan for incident response in-region
When something goes wrong — biased output, hallucinated medical advice, leaked data — your response time matters. Pre-arrange in-market PR, in-market legal, and in-market customer support. 24-hour response times in the local language are now table stakes.
